Terms and Conditions

1. Trader details

The higitrade.com online store is operated by Higiena Trade, a wholesale distributor of professional cleaning and hygiene products, with its registered seat and address of management in Sofia, Republic of Bulgaria.

Contact: email office@higienatrade.bg, phone 0888 55 36 26, working hours Monday to Friday 09:00-18:00. The supervisory authorities for this activity are the Commission for Consumer Protection (CPC) and the Commission for Personal Data Protection (CPDP).

2. Scope and definitions

These Terms govern the relationship between Higiena Trade ('the Seller', 'we') and any person who uses this website and places orders through it ('Customer', 'Buyer').

A 'Consumer' is a natural person acquiring goods outside their trade or profession. A 'Business customer' is a person ordering for the purposes of their business. Some provisions below apply only to consumers, and this is stated explicitly.

By registering an account or submitting an order, the Customer confirms that they have read, understood and accepted these Terms in their version in force at the time.

3. Account registration and approval

Orders may be placed as a registered business customer or as a guest. Business account registrations are reviewed and approved by our team, after which the Customer gains access to customer (contract) pricing and to online ordering.

The Customer is responsible for the accuracy of the details provided at registration, for keeping them up to date, and for safeguarding access to their account. Registration with third-party or false data is not permitted.

4. Products and prices

All prices on the website are in euros (EUR), VAT included (20%). The final amount payable is shown before you confirm the order.

Approved business customers see contract/customer prices, which may differ from the standard displayed prices. Prices, stock availability and product information may change without notice; the data confirmed at the moment an order is accepted prevails for that order.

We make every effort to keep descriptions, images and specifications accurate, but we do not exclude technical errors. In the event of an obvious price or description error we are not bound by it and will notify the Customer before fulfilment.

5. Orders and formation of the contract

An order is deemed placed when it is submitted through the website. The automatic electronic acknowledgement of a registered order confirms receipt but does not in itself constitute acceptance on our part.

The sale contract is deemed concluded at the moment we confirm and/or dispatch the order. We reserve the right to decline or amend an order in case of lack of stock, an obvious error or suspected misuse, having notified the Customer and refunded any amounts paid.

6. Delivery

Deliveries are carried out via the Econt courier nationwide across Bulgaria, typically within 1-2 business days after the order is confirmed. We deliver to an Econt office or an Econtomat (APS), as well as to an address specified by the Customer.

• Free delivery on orders over EUR 100.
• For orders below this threshold, the Econt courier rate applies, shown at checkout.
• Delivery times are indicative and may be extended in cases of force majeure or circumstances beyond our control.
• The risk of accidental loss or damage passes to the Customer when the goods are handed over to them or to a person designated by them.

7. Payment

The Customer selects a payment method at checkout from:

• Bank transfer against an issued invoice.
• Cash on delivery (payment on receipt).
• Deferred invoice payment - for approved partners only.
• Online payment by bank card via a secure payment operator.

8. Right of withdrawal (consumers only)

A consumer (natural person) has the right to withdraw from a distance contract without giving a reason within 14 days from the date they receive the goods. To exercise this right, the consumer notifies us with an unambiguous statement at office@higienatrade.bg before the deadline expires.

The goods are returned without undue delay and no later than 14 days after the notification, in resaleable condition and packaging. We refund the amounts paid, including standard delivery costs, within 14 days of receiving the returned goods or proof that they have been sent back.

The right of withdrawal does not apply in the cases set out in the Consumer Protection Act - for example sealed goods which are not suitable for return for hygiene reasons and were unsealed after delivery. This right does not apply to business customers (legal entities and traders).

9. Statutory guarantee and claims

The Seller is liable for the conformity of the goods with the contract under applicable Bulgarian law. For consumers, the statutory guarantee of conformity applies for the periods provided by law.

On receipt, the Customer should inspect the shipment and report any visible damage or discrepancies to the courier at the moment of delivery. For hidden defects or any mismatch between what was delivered and what was ordered, the Customer notifies us without undue delay at office@higienatrade.bg, describing the issue and providing the order/invoice number and photos where possible.

After reviewing a justified claim, we bring the goods into conformity - replacement, repair, price reduction or refund - as provided by law and appropriate to the specific case.

10. Limitation of liability

Products are intended for professional use in accordance with the manufacturer's instructions, the safety data sheets and applicable requirements. The Customer is responsible for the correct selection, storage, dosing and use of the products.

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of profit or harm arising from improper use or storage of the delivered products. Nothing in these Terms limits any liability that cannot be excluded by law.

11. Intellectual property

All content on the website - texts, images, logo, graphics and structure - is protected and belongs to Higiena Trade or to the respective rights holders.

Reproducing, copying or using the content for commercial purposes without prior written consent is not permitted.

12. Personal data

We process personal data for the purposes of registration, order fulfilment and communication with the Customer, in accordance with applicable data protection legislation.

13. Amendments to the Terms

We reserve the right to update these Terms and Conditions. The version in force at the time an order is submitted applies to that order.

The current version is always available on this page, with the date of the last update indicated.

14. Governing law and dispute resolution

All matters not regulated by these Terms are subject to the applicable law of the Republic of Bulgaria.

The parties shall resolve disputes by mutual agreement. Consumers may refer a dispute to the Commission for Consumer Protection (kzp.bg) or use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Failing agreement, the dispute is referred to the competent Bulgarian court.
